These Terms of Use ("Agreement") govern your access to and use of the website located at exoticpuppymart.com (the "Site") and all related services operated by Exotic Puppy Mart LLC, a company registered under the laws of the State of Florida, United States, with its principal place of business at 1200 Brickell Avenue, Suite 500, Miami, FL 33131, USA (hereinafter "Company," "we," "us," or "our").
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree with any part of these Terms, you must discontinue use of the Site immediately.
1.Definitions
1.1 "Service" — the website exoticpuppymart.com, its subdomains, mobile-optimized versions, and all content, features, and functionality made available therein.
1.2 "User" / "you" — any individual or legal entity that accesses, browses, or interacts with the Service in any capacity.
1.3 "Content" — all text, photographs, images, descriptions, pricing information, trademarks, logos, and other materials published on the Service by the Company or third parties.
1.4 "Order" — an inquiry or purchase request submitted by you through the Site's cart and checkout system.
1.5 "Animal(s)" — captive-bred reptiles, amphibians, invertebrates, and fish offered for sale on the Service.
2.Eligibility and Acceptance
2.1 You must be at least 18 years of age and legally capable of entering into binding contracts under the laws of your jurisdiction to place an Order or transact on the Service.
2.2 By using the Service, you represent and warrant that you meet the eligibility requirements set forth in Section 2.1 and that all information you provide is accurate, current, and complete.
2.3 Use of the Service on behalf of a company, organization, or other legal entity constitutes acceptance of these Terms on behalf of that entity, and you represent that you have the authority to bind such entity to this Agreement.
3.Description of Service
3.1 Exotic Puppy Mart provides an online marketplace for captive-bred exotic animals, including but not limited to reptiles, amphibians, invertebrates, and ornamental fish. All animals listed on the Service are bred in captivity by vetted partner breeders; we do not sell wild-caught specimens.
3.2 The Service facilitates inquiry submissions and order requests. Completion of an Order on the Site constitutes an inquiry, not a binding contract of sale. A binding sale agreement is formed only upon our written confirmation of availability, payment terms, and shipping arrangements communicated to you by email.
3.3 We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice and without liability to you.
4.Rules of Use
4.1 You agree to use the Service solely for lawful purposes and in accordance with this Agreement and all applicable federal, state, and local laws and regulations, including laws governing the ownership, purchase, and importation of exotic animals in your jurisdiction.
4.2 You are solely responsible for verifying whether the acquisition, ownership, or keeping of any Animal offered on the Service is lawful in your jurisdiction prior to placing an Order.
4.3 You agree not to use the Service to engage in any fraudulent activity, provide false information, impersonate another person or entity, or circumvent any security or access-control mechanisms.
4.4 Automated scraping, crawling, or data extraction from the Service without our prior written consent is strictly prohibited.
5.Prohibited Activities
You must not, directly or indirectly:
5.1 Reproduce, redistribute, sell, or commercially exploit any Content from the Service without our prior written consent;
5.2 Introduce any malware, virus, trojan horse, spyware, or other harmful or disruptive code into the Service;
5.3 Attempt to gain unauthorized access to any portion of the Service, its servers, databases, or connected systems;
5.4 Use the Service for the resale or commercial redistribution of Animals without written authorization from the Company;
5.5 Submit false, incomplete, or misleading information in the course of placing an Order.
6.Intellectual Property
6.1 All Content published on the Service — including but not limited to logos, trade names, photographs, text, product descriptions, and the design and layout of the Site — is the exclusive property of Exotic Puppy Mart LLC or its licensed content providers and is protected by applicable intellectual property laws.
6.2 You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with this Agreement. No other rights are granted.
6.3 Any feedback, suggestions, or ideas you voluntarily provide regarding the Service may be used by the Company without restriction or compensation to you.
7.Limitation of Liability
7.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXOTIC PUPPY MART LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.2 IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
7.3 The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.Termination of Access
8.1 We reserve the right to suspend or terminate your access to the Service, with or without prior notice, if we determine in our sole discretion that you have violated any provision of this Agreement, engaged in fraudulent activity, or if required to do so by applicable law or government order.
8.2 Upon termination, your right to use the Service ceases immediately. Provisions of this Agreement that by their nature should survive termination shall survive, including Sections 6, 7, 9, and 10.
8.3 Any data submitted by you as part of an Order inquiry will be retained for the period specified in our Privacy Policy, after which it will be deleted or anonymized in accordance with applicable data protection laws.
9.Modifications to Terms
9.1 We reserve the right to update or modify this Agreement at any time. The revised version will be posted on this page with an updated "Last Updated" date. Continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
9.2 For material changes, we will make reasonable efforts to provide notice via email or a prominent notice on the Site prior to the changes becoming effective.
10.Governing Law and Dispute Resolution
10.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
10.2 Any dispute, controversy, or claim arising out of or in connection with this Agreement, or the breach, termination, or invalidity thereof, shall first be submitted to non-binding mediation in Miami-Dade County, Florida. If mediation fails to resolve the dispute within 30 days, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
10.3 YOU AND EXOTIC PUPPY MART LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL IN ANY LEGAL ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICE.
